1. Acceptance of Terms

By accessing and using pealz.music ("the Platform"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform.

2. Platform Description

pealz.music is an artist platform operated by Pealz, offering:

• Original beats and instrumentals for purchase
• Free beats for non-commercial use
• Community challenges and engagement opportunities
• Music releases and content from Pealz

3. Account Creation and Security

Accounts may be created automatically when you make a purchase or download free beats. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Purchases and Licenses

When you purchase a beat license:

• You receive the specific rights outlined in the purchased license type
• All sales are final. Due to the digital nature of the products, refunds, exchanges, or cancellations are not provided once the purchase is completed and the files have been delivered. If a technical issue prevents you from accessing your files, please contact us and we will resolve it promptly.
• You must comply with the usage limits of your purchased license
• Purchased files are for your use only and may not be resold or redistributed

Licenses are granted to the original purchaser only and are non-transferable. You may not sublicense, assign, or transfer your rights to any third party.

If usage exceeds the limits of the purchased license (including but not limited to streaming volume, distribution scale, or monetization scope), the buyer is required to upgrade to the appropriate license tier before continuing such use.

Continued use beyond licensed limits without upgrading constitutes a breach of these Terms and may result in content claims, takedowns, or legal enforcement.

Pealz reserves the right to register instrumentals with content identification systems (such as YouTube Content ID). Licensed users may encounter automated claims and are responsible for resolving such claims using their valid license documentation.

In the event of any conflict between these Terms and the specific license terms, the license terms for the purchased product shall take precedence.

5. Free Beats

Free beats are provided for non-commercial use only. By downloading a free beat:

• You must credit Pealz in your work ("Prod. by Pealz")
• You may not upload free beats to streaming platforms (Spotify, Apple Music, etc.)
• You may not monetize content using free beats
• You may not use the beat for commercial releases without purchasing a license
• The beat remains the property of Pealz
• You may create demos, practice recordings, and non-monetized content

6. Challenge Submissions

When you submit an entry to a Pealz challenge:

• You grant Pealz permission to feature your entry on the platform and social media
• You retain ownership of your original content
• You confirm that your submission does not infringe on third-party rights
• Pealz reserves the right to select featured entries and winners at our discretion

7. Intellectual Property

All beats, music, artwork, and content on pealz.music are protected by copyright and owned by Pealz unless otherwise noted. Unauthorized use, reproduction, distribution, or commercial exploitation outside the scope of a valid license is strictly prohibited.

8. Prohibited Uses

You may not:

• Claim ownership of any beats or content created by Pealz
• Resell, redistribute, or sublicense purchased beats or files
• Use beats in ways that violate laws or infringe on third-party rights
• Attempt to reverse engineer, decompile, or extract source files
• Use automated systems to scrape or download content

9. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free access to the Platform
• The availability of specific beats or content
• That purchased files will be compatible with all software or systems

10. Limitation of Liability

Pealz shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform or purchased content.

11. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms. We will update the "Last updated" date at the top of this page when changes are made.

12. Governing Law

These Terms of Use shall be governed by and interpreted in accordance with the laws of the Republic of Austria, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Austria.

If you are a consumer located in the European Union, you may also be entitled to certain protections under the consumer protection laws of your country of residence.
